RECOGNITION AND ASSUMPTION OF INHERENT RISKS

I understand and acknowledge that participation in Brazilian Jiu-Jitsu, martial arts, self-defense training, physical conditioning, open mats, competitions, demonstrations, seminars, and other activities offered or associated with Xequemate Jiu-Jitsu ("Gym") involves strenuous physical activity and physical contact and carries inherent and potentially serious risks.

These risks include, but are not limited to, falls; collisions; throws; takedowns; joint locks; chokes and strangulation techniques; grappling; striking where applicable; contact with other participants; overexertion; use of training equipment; exposure to communicable illnesses or infections; and other risks associated with martial arts and physical activity.

I understand that these activities may result in injuries including, but not limited to, bruises, cuts, sprains, strains, dislocations, broken bones, concussions, head, neck or spinal injuries, illness, infection, paralysis, permanent disability, or death.

I knowingly and voluntarily assume all risks associated with my participation, or my minor child's participation, whether those risks are known or unknown, anticipated or unanticipated.

PHYSICAL AND MEDICAL RESPONSIBILITY

I understand that I am responsible for determining whether I, or my minor child, am physically and mentally capable of participating in Gym activities.

I agree to inform the Gym of any known physical, medical, or psychological condition, injury, limitation, or other concern that may affect safe participation.

I understand that Gym instructors, owners, employees, and representatives are not responsible for determining my medical fitness or my child's medical fitness to participate.

RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate in activities offered by the Gym, I voluntarily agree, to the fullest extent permitted by applicable law, to release and discharge Xequemate Jiu-Jitsu and its owners, members, officers, instructors, employees, independent contractors, agents, representatives, affiliates, successors, insurers, and assigns ("Released Parties") from claims arising from injury, illness, property damage, disability, or death connected with participation in Gym activities or use of Gym facilities or equipment.

This release is intended to include claims arising from the ordinary negligence of a Released Party to the fullest extent such claims may legally be released or waived.

I understand that by signing this document, I am giving up substantial legal rights.

INDEMNIFICATION AND HOLD HARMLESS

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, demands, causes of action, liabilities, losses, or damages arising from my participation, or my minor child's participation, in Gym activities, subject to applicable law.

PERSONAL PROPERTY

I understand that the Gym is not responsible for personal property that is lost, stolen, misplaced, or damaged while on or around Gym premises or while participating in Gym activities.

COMPLIANCE WITH GYM RULES

I agree that I, or my minor child, will comply with Gym safety rules, instructor directions, hygiene requirements, and standards of conduct.

I understand that intentionally dangerous conduct, misuse of equipment, failure to follow instructor directions, or continued disregard of Gym rules may result in removal from training or termination of membership.

MINOR PARTICIPANTS

If the participant is under 18 years of age, I certify that I am the participant's parent or legal guardian or otherwise have legal authority to execute this agreement on the participant's behalf.

I acknowledge the risks described in this agreement and consent to the minor's participation in Brazilian Jiu-Jitsu and other Gym activities.

ACKNOWLEDGMENT

I acknowledge that Brazilian Jiu-Jitsu and martial arts are physical contact activities that can result in serious injury, permanent disability, or death.

I acknowledge that I have had an opportunity to read this entire Liability Waiver, Release & Assumption of Risk before signing.

I voluntarily assume the risks associated with participation and agree to the release and waiver provisions stated above.

I HAVE READ THIS AGREEMENT AND UNDERSTAND ITS CONTENTS. I SIGN IT FREELY AND VOLUNTARILY AND UNDERSTAND THAT IT AFFECTS IMPORTANT LEGAL RIGHTS.

MEMBERSHIP AGREEMENT & CANCELLATION POLICY

This Membership Agreement establishes the terms and conditions of membership with Xequemate Jiu-Jitsu ("Gym").

MEMBERSHIP AND AUTOMATIC BILLING

Membership dues are billed automatically according to the membership plan selected during enrollment.

By enrolling in a recurring membership and providing a valid payment method, the member or financially responsible party authorizes the Gym and its payment processor to automatically charge the payment method on file for membership dues and other properly authorized charges as they become due.

Membership payments are made in advance for the applicable membership period.

Unless otherwise expressly stated in the selected membership plan, recurring memberships continue and automatically renew until properly canceled according to this Agreement.

PAYMENT RESPONSIBILITY

Members are responsible for maintaining a valid payment method and sufficient funds for scheduled membership payments.

If a payment is declined or otherwise fails, the payment may automatically be attempted again.

The Gym's existing fee policy provides for a $25 service fee for a returned payment and a $25 fee for a credit-card chargeback.

Failure to make required membership payments may result in suspension or termination of membership privileges.

MEMBERSHIP DUES

Membership pricing is based on the membership selected at enrollment, including any applicable family, military, or other approved discount.

The Gym reserves the right to modify membership dues. Any change to dues will be handled in accordance with the applicable membership terms and applicable law.

30-DAY CANCELLATION POLICY

Xequemate Jiu-Jitsu requires at least 30 days' notice before the member's next scheduled billing date to cancel a membership before that payment is due.

If cancellation is submitted fewer than 30 days before the next scheduled billing date, the next scheduled membership payment will still be charged, and the membership will remain active through the period covered by that payment.

Memberships remain active and continue to be billed until a cancellation request satisfying this policy has been received.

CANCELLATION REQUEST

To cancel a membership, the member or financially responsible party must provide the Gym with a cancellation request.

Reason for cancellation (optional):

Submission of a cancellation request does not eliminate amounts already due or a scheduled payment that falls within the 30-day cancellation period.

NO REFUNDS

Membership fees are non-refundable.

The Gym does not provide refunds for unused classes, missed classes, failure to attend, or a member choosing not to use the facility during an already-paid membership period.

GYM RULES AND MEMBER CONDUCT

Members agree to follow all current Gym rules, safety procedures, hygiene requirements, and reasonable instructions from instructors and staff.

Xequemate Jiu-Jitsu is committed to maintaining a safe, respectful, and professional training environment.

Threatening, harassing, obscene, indecent, intentionally dangerous, fraudulent, illegal, or seriously disruptive conduct will not be tolerated.

The Gym reserves the right to suspend or terminate membership for violations of Gym rules, unsafe behavior, unacceptable conduct, nonpayment, or conduct that threatens the safety or reasonable enjoyment of other members or staff.

Termination resulting from a member's violation of these standards does not entitle the member to a refund of previously paid membership dues.

DAMAGE TO GYM PROPERTY

Members are responsible for damage to Gym property caused by their own intentional or negligent conduct or by the intentional or negligent conduct of their guests or dependent children.

NON-TRANSFERABLE MEMBERSHIP

Membership privileges are personal to the enrolled member and may not be sold, assigned, transferred, or shared with another person unless expressly authorized by the Gym.

LIABILITY WAIVER

Participation in Gym activities is subject to the Gym's separate Liability Waiver, Release & Assumption of Risk.

The member acknowledges that participation in Brazilian Jiu-Jitsu and related activities involves inherent risks and agrees that the applicable Liability Waiver must be accepted before participation.

ENTIRE AGREEMENT

This Membership Agreement, together with the applicable membership plan and any separately executed Gym policies or waivers incorporated into the membership, constitutes the agreement governing membership.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

MEMBER ACKNOWLEDGMENT

I understand that my membership is automatically billed according to the membership plan I selected.

I understand the 30-day cancellation policy and that if I cancel fewer than 30 days before my next scheduled billing date, that payment will still be charged.

I understand that membership fees are non-refundable.

I agree to follow Xequemate Jiu-Jitsu's rules, safety requirements, and standards of conduct.

I have read and agree to the terms of this Membership Agreement.

I acknowledge that I have read and understand this Membership Agreement and voluntarily agree to its terms.
